What Is Probate?

Probate is the legal transfer of a deceased person's assets to his or her beneficiaries. If the person passed away with a detailed will in place, avoiding probate may be possible, but in most cases, it is a process that must be endured.

Probate Administration

When an estate goes through the probate process, a personnel representative must be appointed to serve as the "manager" of the deceased's property and assets. The attorneys at our firm can fill this role or guide a person of your choosing through their responsibilities, which include:

  • Carrying out the necessary tasks of the estate
  • Avoiding conflicts of interest
  • Act impartially to all heirs, beneficiaries and creditors
  • Protecting estate assets
  • Delegating wisely
  • Providing information to heirs and beneficiaries
  • Maintaining a record of all transactions

Probate Litigation

In some cases, an heir, beneficiary or creditor may not agree with the way the property of the deceased is being distributed. They may choose to contest the will in an effort to change the outcome of proceedings. Our firm represents both those who wish to contest a will and parties who require defense against such proceedings.
