What Is Divorce Mediation?
In divorce mediation, both parties and their attorneys work with a neutral mediator to discuss issues. Mediation allows participants to speak about their thoughts and concerns regarding alimony, child custody and other divorce-related topics. Together, parties reach a mutually acceptable agreement detailing the terms of their divorce. Many people who participate in divorce mediation are very satisfied with the results because they have had a chance to create their own solutions. Studies have shown that people are more likely to adhere to the agreements made in mediation and are less likely to return to court in the future.
Divorce Mediation Is Non-Binding
The goal in divorce mediation is to reach agreement with your spouse that meets your family's needs and protects everyone's interests. However, mediation is non-binding. If at any time communications breaks down and negotiations fail, the case can proceed to trial. Information shared during mediation is confidential and cannot be used in the courtroom.
The DeBast, McFarland & Richardson Approach
At our firm, we attempt to settle a 100 percent of our divorce cases. We strongly believe mediation is often the best alternative to resolving a dispute, as it can save both time and the cost of having to go to trial, while preserving amicable relationships. However, if at any time divorce mediation does not appear to be the correct choice in your case, we do not hesitate to proceed toward trial.
